1. Scope and Severability Clause

DS Security KG (Dynamic Shooting Austria), based at Linzer Straße 22, 4222 St. Georgen/Gusen, provides services exclusively on the legal basis of these General Terms and Conditions (hereinafter referred to as “GTC”). The version valid at the time of contract conclusion shall apply. Deviations from these and other supplementary agreements with the customer are only effective if made in writing and confirmed by DS Security KG (Dynamic Shooting Austria) in writing (by post or email).

Changes to these GTC will be communicated to the customer and shall be deemed agreed if the customer does not object in writing within 14 days. The customer will be expressly informed in the notification of the significance of remaining silent.

Mandatory statutory provisions of consumer protection law remain unaffected.

If individual provisions of these GTC are invalid or become invalid, this shall not affect the legal validity of the remaining contractual provisions. The invalid provision shall be replaced by a valid one that comes closest to the meaning and purpose of the invalid one.


2. Conclusion of Contract

Unless otherwise agreed, the contract between the customer and DS Security KG (Dynamic Shooting Austria) is concluded through the customer’s order (assignment) and the acceptance of the order by DS Security KG (Dynamic Shooting Austria).

The customer’s order may be placed in writing, electronically (especially in the case of custom-made or special orders), or via the web shops of DS Security KG (Dynamic Shooting Austria).


3. Contract Withdrawal, Right of Withdrawal, Contract Termination

If DS Security KG (Dynamic Shooting Austria) subsequently discovers an error in product information, pricing, or availability, the customer will be informed immediately by email. The customer may then reconfirm the order under the amended conditions. Otherwise, DS Security KG (Dynamic Shooting Austria) is entitled to withdraw from the contract.


3.1 Withdrawal Instructions

Information on exercising the right of withdrawal in the case of a purchase contract for the delivery of one or more goods in a single shipment.


3.2 Right of Withdrawal

The customer has the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which the customer or a third party designated by the customer, who is not the carrier, has taken possession of the goods.

To exercise the right of withdrawal, the customer must notify:

by means of a clear written statement (e.g., letter sent by post or email). The withdrawal declaration is not subject to any particular form. The attached model withdrawal form may be used, but it is not mandatory.

To comply with the withdrawal deadline, it is sufficient if the notification of exercising the right of withdrawal is sent before the withdrawal period expires and reaches DS Security KG on time.

Exclusions from the right of withdrawal or exchange include:

  • goods produced according to customer specifications,

  • goods clearly tailored to the customer’s personal needs (including items printed, embroidered, or otherwise personalized by DS Security KG),

  • damaged or used goods (even if washed),

  • goods showing signs of use, odors, or contamination.

Returns are only accepted if:

  • the goods are returned in their original packaging,

  • the goods are returned with all original labels,

  • the return shipment is sufficiently prepaid (parcels sent “freight collect” will not be accepted).

The buyer acknowledges that if individual items from a set offer are returned, all discounts and previous discount agreements for the set expire and a corresponding price adjustment will be made (by deduction from the refundable amount).


3.3 Consequences of Withdrawal

Withdrawal results in cancellation of the purchase contract and obliges the buyer to return the goods. DS Security KG (Dynamic Shooting Austria) will refund the purchase price and the shipping costs to the customer. Return shipping costs are generally borne by the buyer. DS Security KG may, at its own discretion, cover return shipping costs in cases of its own fault (e.g., delivery of incorrect goods).

Refunds will only be made after receipt and inspection of the returned goods or upon submission of proof that the goods have been returned, within the statutory deadlines, using the payment method originally chosen by the customer.

The customer shall only be liable for any diminished value of the goods if such loss of value results from handling that was not necessary to establish the nature, characteristics, and functioning of the goods.


3.5 Termination of Contract

DS Security KG (Dynamic Shooting Austria) is entitled to terminate the contract with immediate effect for important reasons.

An important reason exists in particular if performance becomes impossible for reasons attributable to the customer, or is further delayed despite the granting of a 14-day grace period, or if the customer repeatedly violates essential obligations under this contract despite written warning with a 14-day grace period (e.g., payment of due amounts, duty to cooperate).

An important reason also exists if justified concerns arise regarding the customer’s creditworthiness and the customer neither makes advance payments nor provides adequate security upon request.

The customer is entitled to terminate the contract for important reasons without granting a grace period if DS Security KG (Dynamic Shooting Austria) repeatedly violates essential provisions of this contract despite written warning by the customer (by post or email) with a reasonable grace period of at least 14 days.


4. Retention of Title

The goods remain the property of DS Security KG (Dynamic Shooting Austria) until full payment of the purchase price, including all related costs, ancillary expenses, and applicable fees.


5. Prices and Payment

All prices are inclusive of the respective statutory value-added tax (VAT).

If costs exceed the estimate provided in writing by DS Security KG (Dynamic Shooting Austria) by more than 10%, DS Security KG (Dynamic Shooting Austria) will notify the customer of the higher costs. The excess costs shall be deemed approved by the customer if the customer does not object in writing (by post or email) within three working days and simultaneously proposes more cost-effective alternatives.

If the cost increase is up to 10%, separate notification is not required. Such an increase is considered approved in advance by the customer.

The price is due immediately upon receipt of the invoice and without deductions, unless special payment terms have been expressly agreed in writing (by post or email). This also applies to the reimbursement of all cash expenses and other costs incurred.

The goods delivered by DS Security KG (Dynamic Shooting Austria) remain the property of DS Security KG (Dynamic Shooting Austria) until full payment of the purchase price including all ancillary costs.

Only the payment methods specified in the online shops of DS Security KG (Dynamic Shooting Austria) are accepted.

If payment by invoice is agreed, the invoice must be paid in full within 7 days from the invoice date.

Shipping of goods will only take place after receipt of payment.

DS Security KG (Dynamic Shooting Austria) reserves the right to withdraw from the purchase contract in cases of price changes, errors, or printing mistakes.

DS Security KG (Dynamic Shooting Austria) also reserves the right to modify or cancel special discounts (such as authority discounts or discounts for shooting club members and associations) at any time and without giving reasons.


6. Due Date and Default

In the event of default of payment by the customer, DS Security KG (Dynamic Shooting Austria) may declare all services and partial services provided under other contracts with the same customer immediately due.

DS Security KG (Dynamic Shooting Austria) is not obliged to provide further services until the outstanding amount has been settled (right to withhold goods/orders). The obligation to pay compensation remains unaffected.

If installment payments have been agreed, DS Security KG (Dynamic Shooting Austria) reserves the right, in case of late payment of installments or ancillary costs, to demand immediate payment of the total outstanding debt (“loss of term”).

The customer is not entitled to offset own claims against claims of DS Security KG (Dynamic Shooting Austria) unless such claims have been acknowledged in writing by DS Security KG (Dynamic Shooting Austria) or legally established.

For each reminder, dunning fees of €20.00 will be charged. Default interest of 12% p.a. (calculated on a 360-day basis) will apply.

DS Security KG (Dynamic Shooting Austria) is entitled to assign outstanding claims to collection agencies and/or attorneys for collection purposes or to transfer such claims to them.

According to § 1333 para. 2 ABGB (Austrian Civil Code), the customer is liable for all necessary and appropriate collection and enforcement costs incurred in recovering overdue payments, including default interest, dunning fees, and collection costs.

DS Security KG (Dynamic Shooting Austria) is under no obligation to issue written reminders in case of payment arrears.

Stated delivery or performance deadlines are approximate and non-binding unless expressly agreed otherwise. Binding delivery dates must be confirmed in writing (by post or email) by DS Security KG (Dynamic Shooting Austria).

If delivery or performance is delayed due to circumstances beyond the control of DS Security KG (Dynamic Shooting Austria), such as force majeure or other unforeseeable events, the performance obligations shall be suspended for the duration and scope of the hindrance. All other deadlines shall be extended accordingly.

If such delays exceed two months, both the customer and DS Security KG (Dynamic Shooting Austria) are entitled to withdraw from the contract.

If DS Security KG (Dynamic Shooting Austria) is in default, the customer may only withdraw from the contract after granting a grace period of at least 14 days in writing (by post or email). Claims for damages by the customer due to non-performance or delay are excluded, except in cases of intent or gross negligence by DS Security KG (Dynamic Shooting Austria). This exclusion does not apply to custom-made or personalized goods.


7. Shipping and Costs

The risk is transferred to the customer as soon as the goods are handed over to the customer or, in the case of shipping, when DS Security KG (Dynamic Shooting Austria) has handed over the goods to the carrier of its choice.

Orders generally (but not obligatorily) arrive at an Austrian delivery address within 2–3 days after handover to the shipping provider. The shipping costs to be borne by the customer are communicated at the time of contract conclusion.

Shipping within Austria costs a flat rate of EUR 5.00 up to 30 kg when shipped via General Logistics Systems Austria GmbH (GLS), subject to change. If the customer explicitly requests shipment by Österreichische Post AG, shipping fees of EUR 8.00 up to 30 kg will apply.

For shipments abroad, shipping fees are charged according to actual costs.


8. Regulated Products / Export Control

Products subject to U.S. (re-)export control regulations under ITAR (International Traffic in Arms Regulations) and/or EAR (Export Administration Regulations), as well as products listed in the EU Common Military List and their components or spare parts, are shipped exclusively within the borders of the Republic of Austria.

This applies in particular to items such as magazines, electronic sights for military purposes, flash suppressors, and various products of U.S. origin.

For customers outside Austria, such products are generally neither visible nor available for purchase in the online shop. In cases of suspected circumvention of these provisions, DS Security KG (Dynamic Shooting Austria) reserves the right to cancel the respective order.

The customer undertakes to comply with the relevant export control laws and regulations and not to attempt to circumvent them. Violations of these regulations may result in legal consequences.

These provisions apply without restriction and form an integral part of our General Terms and Conditions.


9. Warranty and Liability

The customer must report any defects immediately, at the latest within five days after delivery and performance by DS Security KG (Dynamic Shooting Austria). Hidden defects must be reported within five days of discovery. Notification must be made in writing and include a description of the defect. Otherwise, the goods shall be deemed accepted, and the performance approved. In this case, the assertion of warranty and compensation claims as well as the right to contest the contract due to error is excluded.

In the event of a justified and timely notice of defects, the customer is entitled to rectification or replacement of the goods and services by DS Security KG (Dynamic Shooting Austria), which will remedy the defect within a reasonable period. The customer must enable DS Security KG (Dynamic Shooting Austria) to take all measures necessary to investigate and remedy the defect. DS Security KG (Dynamic Shooting Austria) is entitled to refuse rectification if it is impossible or associated with disproportionately high costs. In such cases, the customer is entitled to statutory rights of rescission or reduction. If rectification is chosen, the customer must return the defective goods at his own expense.

The warranty period for movable goods is 2 years from delivery and performance. The customer is not entitled to withhold payments due to complaints.

In cases of slight negligence, DS Security KG (Dynamic Shooting Austria) and its employees, contractors, or agents shall not be liable for property or financial damage to the customer, regardless of whether it concerns direct or indirect damage, lost profit, consequential damage due to defects, delay, impossibility, breach of obligations, culpa in contrahendo, or defective/incomplete performance.

The burden of proof for gross negligence by DS Security KG (Dynamic Shooting Austria) lies with the injured party.

Any liability of DS Security KG (Dynamic Shooting Austria) for claims made against the customer by third parties due to the services provided by us is expressly excluded, provided DS Security KG (Dynamic Shooting Austria) has met its duty to inform or such a duty was not recognizable. Slight negligence does not result in liability.

Customer compensation claims against DS Security KG (Dynamic Shooting Austria) expire six months after knowledge of the damage, and in any case three years after the event giving rise to the claim.

Compensation claims are limited to the net contract value.


10. Proof of Age

The sale of knives classified as weapons under the Austrian Weapons Act, switchblades, camping axes, machetes, and similar items is subject to the following legal requirements:

  • sale only to persons over 18 years of age,

  • requirement: the customer must, without being asked and without delay, provide a copy of an official photo ID electronically at the time of ordering by sending it to office@dynamic-shooting.at

  • the goods will only be shipped after receipt of the copy of the official photo ID.

DS Security KG (Dynamic Shooting Austria) is not obliged to verify the authenticity of the submitted official photo ID. In cases of forged IDs, all liability on the part of DS Security KG (Dynamic Shooting Austria) is excluded.


11. Data Protection

DS Security KG (Dynamic Shooting Austria) stores and uses customers’ personal data exclusively for order processing. Data will not be passed on to third parties for commercial or other purposes in accordance with the GDPR. Customer data may be deleted or corrected at any time upon request in accordance with the GDPR.


12. Applicable Law, Place of Performance, and Jurisdiction

The contractual relationship, including any disputes regarding its conclusion, is governed exclusively by Austrian law.

The place of performance and exclusive place of jurisdiction is the District Court of Linz or the Regional Court of Linz, unless otherwise determined by § 51 JN (Jurisdictional Norm).

For lawsuits against consumers, the competent court is determined according to § 14 KSchG (Austrian Consumer Protection Act), which is the consumer’s place of residence, habitual residence, or place of employment, provided it is located in Austria.
